Following are some of the bills being monitored by the Washington State Labor Council, and their status.  There are additional bills that the WSLC supports or opposes. If your affiliated union would like to add a bill of particular concern to this Legislative Tracker, please contact us. Links on the bill numbers are to the State Legislature's web site for more information on each bill. For details on these bills, also see our WSLC Legislative Updates.

Bills listed in GRAY are dead, having missed a legislative cutoff deadline. Remember, in Olympia, dead is relative. Bills can become budget provisos, and can be resurrected by other procedural means.

This would add Western and Eastern State Hospitals, as well as other health care entities, to the law protecting registered and licensed nurses from mandatory overtime.

HB 1370 Green Passed House 93-0; passed Senate 47-0; signed by the Governor  Support

Clarifying the law to exempt public workers from prevailing-wage surveys.

HB 1384 Kenney Passed Higher Education; died in Appropriations Support

Providing for academic employee salary increments for community and technical colleges. (Companion SB 5495 also died.) The WSLC strongly urges that these pay raises by funded in the budget.

HB 1503 Conway Passed Commerce & Labor and Appropriations; died in Rules Support

Injured Workers Medical Rights bill, protecting injured workers' interests in the Independent Medical Exam process.

HB 1569 Cody Passed House 53-44; amended and passed Senate 28-20; House concurs 61-34; partially vetoed by the Governor Support

Creating a "connector" program that standardizes insurance plans to be used by providers throughout the state, creating a range of portable health insurance plans and allowing people who move or change jobs to retain their coverage. (The Governor vetoed the emergency clause and one other section.)

Requiring disclosure to customers of the percentage of automatic service charges paid to servers.

HB 1624 Kagi Passed House 98-0; amended and passed Senate 44-0; House refuses to concur, Senate amends again (repeat); but finally a bill passes both and is signed by the Governor Support

Granting collective bargaining rights to foster parents.

HB 1693 Appleton Passed House 97-0; passed Senate 47-0; signed by the Governor Support

Modifying time periods for collective bargaining by ferry workers.

Creates a pilot project to measure pesticide drift data for use in assessing the potential human health impacts from such exposure to children and adults in schools and communities in agricultural areas.

Replacing dedicated funding for public health services that was lost when the Motor Vehicle Excise Tax was repealed in 1999.

Requires the licensing of paid signature gathering firms, plus training and permitting of paid signature gatherers

HB 2019 McDermott Passed State Government & Tribal Affairs; died in Rules Support

Requires signature gatherers to sign a declaration on the back of the petition attesting that the signatures on the petition are those of registered voters.

HB 2047 McDermott Passed State Government & Tribal Affairs; died in Rules Support

Provides more financial disclosure during the signature-gathering phase of initiative campaigns.

Concerning the use of agency shop fees.

HB 2094 Conway Passed Commerce & Labor; hearing held in Appropriations Support

Creating the Washington Taxpayer Health Care Fairness Act, requiring employers with more than 1,000 workers to reimburse the state for their employees who are on tax-subsidized health plans. 

HB 2106 Kenney Passed Commerce & Labor and Appropriations; died in Rules Support

A bill to strengthen the ability of L&I to deny licenses to contractors with a record of serious legal violations, prohibit exorbitant recruitment fees, and require sufficient bonding so that workers are not stranded in Washington state.

HB 2111 Williams Passed House 80-16; passed Senate 32-17; signed by the Governor Support Granting collective bargaining rights to  Adult Family Home Providers.
HB 2171 Eddy Passed House 97-0; passed Senate 39-8; signed by the Governor Support Crane safety bill requiring mandatory certification of cranes and their operators.
HB 2351 Sells Amended and passed House Finance; died in Rules Support

Prohibiting employers that receive the 2003 aerospace tax incentives from forcing employees to attend captive-audience meetings to re: religion, politics, or unionization. (Amended to require a feasibility study on the above-described policy for all state tax incentives.)

HB 2361 Conway Passed House 75-22; passed Senate 38-10; signed by the Governor Support

Changing collective bargaining eligibility requirements for certain higher education employees.

HJM 4008 Conway Passed Commerce & Labor; now in Rules (this remains alive and available for a vote until adjournment) Support Urges Congress to pass the Employee Free Choice Act.

Requiring any disability insurance, health care service contract, or health maintenance agreement that provides coverage for dependent children to extend that coverage to unmarried dependent children up to the age of 25.

Establishes Medical and Chiropractic Advisory Committees to advise the Department of Labor and Industries.

SB 5373 Kohl-Welles Passed Senate 36-11; passed House 64-30; signed by the Governor Support

Help cut down on unemployment insurance fraud and socialized costs, and also closes the "Professional Employee Organizations loophole" by requiring their clients to maintain their own experience ratings.

SB 5495 Kohl-Welles Passed Higher Education; died in Ways & Means Support

Providing for academic employee salary increments for community and technical colleges. (Companion HB 1384 also died.) The WSLC strongly urges that these pay raises by funded in the budget.

SB 5659 Keiser Passed Senate 32-17; amended and passed by the House 61-36; Senate refuses to concur; final compromise bill passes House 57-41 and Senate 26-21, signed by the Governor.  Support

Establishing Family and Medical Leave Insurance providing all Washington workers, beginning in 2009, with up to five weeks of partial wage replacement at a stipend of $250 a week -- pro-rated for part-timers -- upon the birth or adoption of a child into their families. (The House version and final compromise version removed coverage for family members' health emergencies and the funding source.)

SB 5675 Franklin Passed Senate 37-8; amended and passed House 68-29 Senate concurs 37-10; signed by the Governor Support

Increasing minimum benefits paid to injured workers to the same standard used in the Unemployment Insurance system, which is 15% of the state’s average monthly wage but no greater than 100% of the injured workers’ wages.

SB 5676 Keiser Passed Senate 31-15; passed House 69-29; signed by the Governor Support

Disallows an employer from forcing workers to take their sick leave when they are "kept on salary" for purposes of workers’ compensation. "Kept on salary" status allows employers a premium break since no time-loss payments are recorded, and therefore the employer should pay the worker’s full salary not some portion of it.

Creating a joint legislative task force to review the underground economy in the construction industry

SB 6082 Kohl-Welles Passed Labor & Commerce; now in Rules Support Voluntary separation bill eliminating some of the onerous Unemployment Insurance restrictions imposed in 2003 regarding what can be considered "good cause" for quitting a job and still receiving benefits.
SB 6147 Brown Died in Ways & Means Support Discouraging health-care cost-shifting by employers. The bill would establish a B&O tax surcharge on all retail employers, but provide a tax credit to those employers that invest a certain percentage of their payrolls into employee health benefits.
